Legal
Terms of Use
Draft dated October 19, 2026. Effective date: [DATE OF LAUNCH]
These Terms are an agreement between you and [LEGAL ENTITY NAME] (“Skip the Label”, “we”, “us”) for using skipthelabel.com and our apps (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. Who can use it
You must be at least 13 years old. If you're under 18, you need a parent or guardian's permission, and they agree to these Terms for you. We don't knowingly collect personal information from children under 13 (see the COPPA section of the Privacy Policy). The Service is intended for users in the United States.
2. Not medical advice
Skip the Label is a convenience tool for ingredient preferences. It is not medical, allergy, nutrition or dietary advice, and it is not a substitute for a doctor or dietitian. Ingredient information comes from product labels and databases (such as USDA FoodData Central, Open Food Facts and store data) and can be incomplete, wrong or out of date; manufacturers change recipes. Always read the actual label before you buy or eat a product, especially if you have an allergy or medical condition. Do not rely on the Service to avoid allergens.
3. Your account
- Give a real email address and keep your password secret. You're responsible for activity on your account.
- Some features (sending a list to a cart, making a recipe public) require a verified email.
- One person per account. Don't impersonate anyone or pick a misleading username.
4. Your content
- You keep ownership of the recipes, lists, photos and text you add (“Your Content”).
- You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, process and display Your Content to run and improve the Service. When you make a recipe public, the license also covers displaying it publicly (with your username and display name) and letting other users view it and copy it into their own lists. The license for public display ends when you make the recipe private or delete it, except for copies other users already saved and normal backups.
- Only upload content you have the right to share. When you import a recipe from another website, we save the ingredient list and a link to the source; please don't paste someone else's full recipe text and make it public.
- Recipes and profiles must not include health or medical claims (“cures”, “treats”), hateful or harassing content, spam, or anything illegal.
5. Reporting and removal
Use the Report button on any public recipe or profile, or email support@skipthelabel.com. We may remove content, make a recipe private, or suspend accounts that break these Terms, at our discretion. Copyright owners can send notices to support@skipthelabel.com with the information required by the DMCA (17 U.S.C. § 512(c)(3)). [Register a DMCA agent with the US Copyright Office before launch if relying on safe harbor.]
6. Acceptable use
Don't: scrape or bulk-download the Service or its product data; get around rate limits or security; use bots to create accounts; upload malware; use the Service to send spam; or use it in a way that breaks any law or the terms of the data sources and stores we work with.
7. Stores, prices and links
- Prices, stock and aisle information come from the stores (for example the Kroger API) and can change. The store's own price and stock at checkout always govern.
- We're not affiliated with, endorsed by, or sponsored by any retailer unless we say so. Store names are trademarks of their owners.
- Some links may be paid affiliate links (Instacart, Walmart and others). We'll always disclose them; see the Affiliate Disclosure. Purchases happen on the retailer's site under its terms.
8. Data sources
Ingredient data includes USDA FoodData Central (public domain) and Open Food Facts (© Open Food Facts contributors, ODbL).
9. Changes and availability
The Service is new and may change, break, or be discontinued. We may update these Terms; if a change is significant we'll give notice in the app or by email. Continuing to use the Service after a change means you accept it.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, INCLUDING ACCURACY OF INGREDIENT, PRICE OR AISLE INFORMATION, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY HARM FROM RELYING ON INGREDIENT INFORMATION WITHOUT CHECKING THE LABEL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $50 OR WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. [Lawyer to confirm amount and enforceability.]
12. Indemnity
If you break these Terms or the law, or Your Content infringes someone's rights, you agree to cover our reasonable costs from resulting claims.
13. Governing law
These Terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [Williamson or Travis] County, Texas, unless the law where you live requires otherwise. [Optional: arbitration / class-action waiver — lawyer decision.]
14. Ending your account
You can stop using the Service at any time and ask us to delete your account at support@skipthelabel.com. We may suspend or end accounts that break these Terms.
